A DUI charge can disappear from the driver’s criminal case without erasing the harm you suffered in the crash. If you were injured because another driver may have been impaired, you may wonder whether the dismissal also ends your ability to seek compensation. The criminal case and your injury claim follow different paths, so the outcome of one does not necessarily decide the other.
Here is what a dropped DUI charge can mean for your car accident claim.
The civil injury claim can still continue
A dropped DUI charge does not automatically end your personal injury claim. The state brings a criminal DUI case against the driver, while you can pursue a separate civil claim for injuries and losses caused by the crash. Your claim can still depend on evidence that the driver caused the collision and your injuries, even if the criminal case does not result in a conviction.
Evidence of impairment still matter
Evidence gathered during the crash investigation can still support your claim after prosecutors drop the DUI charge. Police observations, witness statements, test results, video footage and other information may help establish what happened before and during the collision. A dismissal does not necessarily mean that investigators found no evidence of impairment.
The insurer may still dispute liability
The other driver’s insurance company can still question who caused the crash and whether the accident caused your injuries. They may point to the dropped charge when challenging your claim, but that outcome does not automatically resolve the civil case. You can still rely on the available evidence surrounding the collision, your treatment and the losses you suffered.
Civil filing deadlines still apply
You generally have two years to file a personal injury lawsuit in New Jersey, regardless of how long the criminal case takes. N.J.S. 2A:14-2 generally requires an action for an injury caused by another person’s wrongful act, neglect or default to begin within two years after the claim accrues. Waiting for the DUI case to finish could therefore put your separate claim at risk.
Keep the focus on the crash and your injuries
