Injured at work? How to protect your workers’ compensation claim

New Jersey’s workers’ compensation laws are designed to protect employees who are injured while engaging in work-related activities, but claims don’t automatically go smoothly. Just because you were involved in a workplace accident, that doesn’t guarantee your benefits will be approved quickly or at all.

Employers and insurance carriers scrutinize every detail of your claim. Any gaps. Inconsistencies or missteps can lead to delays, reduced benefits or even denials, which is why you need to take the right approach from the beginning.

Report your injury immediately

You have limited time to notify your employer of a workplace accident. New Jersey law provides a 14-day window in most cases, but it’s best to inform your employer as soon as possible. Waiting too long can lead to unnecessary doubts or questions that can weaken your claim.

Get proper medical treatment

Your employer or their insurance carrier typically reserves the right to choose your treating doctor. This is important. You may be left covering any treatment costs if you go to your own doctor without authorization (except in emergencies). Be consistent and honest

It may sound obvious, but inconsistencies in your story can undermine your claim. Be clear and truthful when describing how the injury happened, whether you’re speaking to your employer, doctor or insurance agent. Even small contradictions can be used against you later.

Watch out for common pitfalls

Posting about your injury on social media, missing medical appointments or returning to work too soon can all hurt your claim. Remember, insurance companies are looking for reasons to minimize payouts. Don’t give them one. Lastly, don’t overlook legal support. You’re better off navigating the claims process when you understand your rights and have someone in your corner who knows how the system works.
